Terms of Service

1. Agreement

These Terms of Service ("Terms") govern access to and use of the SkyAgent platform and website at skyagent.com.au ("Service"), operated by Digifix Pty Ltd ("SkyAgent", "we", "us"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the organisation you represent.

2. The Service

SkyAgent provides automated, AI-conducted candidate phone screening for recruitment agencies, including interview calls, recordings, transcripts, AI-generated evaluations, and integration with the JobAdder applicant tracking system. Features may change as the Service evolves.

3. Accounts and JobAdder connection

• You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account.
• Connecting a JobAdder account authorises SkyAgent to read and write data in that account on your behalf (for example, reading applications and posting interview notes and status updates). You may revoke this authorisation at any time.
• You warrant that you are authorised to connect the JobAdder account you link to the Service.

4. Your responsibilities

• Use the Service only for legitimate recruitment purposes and in compliance with applicable laws, including privacy, telecommunications, anti-discrimination, and employment laws.
• Ensure you have an appropriate lawful basis to contact candidates by phone and to record screening interviews in the jurisdictions where your candidates are located.
• Do not use the Service to harass, mislead, or discriminate against any person, or to contact individuals who are not genuine job applicants.
• Do not attempt to interfere with, reverse engineer, or gain unauthorised access to the Service.

5. AI-generated content

Interview evaluations, summaries, scores, and recommendations are generated by artificial intelligence and are provided to assist — not replace — human decision-making. You are responsible for all hiring decisions, and you should review interview recordings, transcripts, and evaluations before acting on them. We do not guarantee that AI-generated output is accurate, complete, or free from bias.

6. Fees

Where fees apply, they will be set out in your order, proposal, or subscription plan. Unless stated otherwise, fees are in Australian dollars, exclusive of GST, and payable in advance. We may suspend the Service for accounts with overdue amounts.

7. Data and privacy

Our collection and handling of personal information is described in our Privacy Policy. As between you and SkyAgent, you retain ownership of the data you and your candidates provide. You grant us the rights needed to process that data to deliver the Service, including through the third-party providers described in the Privacy Policy.

8. Third-party services

The Service depends on third-party platforms, including JobAdder, telephony and voice AI providers, and AI analysis providers. We are not responsible for the availability or acts of third-party services, and your use of them may be subject to their own terms. SkyAgent is an independent product and is not affiliated with or endorsed by JobAdder.

9. Intellectual property

We own all intellectual property in the Service, including its software, design, and branding. These Terms do not grant you any rights in the Service other than the right to use it while your account is active and in good standing.

10. Disclaimers and liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all implied warranties, and our total liability arising out of or in connection with the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law.

11. Suspension and termination

You may stop using the Service and disconnect your JobAdder account at any time. We may suspend or terminate access for breach of these Terms, misuse of the Service, or where required by law. On termination, we will delete or de-identify your data in accordance with our Privacy Policy.

12. General

These Terms are governed by the laws in force in Australia, and the courts of Australia have jurisdiction over any dispute. If any part of these Terms is found unenforceable, the rest remains in effect. We may update these Terms from time to time; the latest version will always be available at skyagent.com.au/terms, and continued use of the Service after an update constitutes acceptance.
